Membership Terms of Use

This is the Membership Terms of Use for membership registration at www.ak100wt.com managed by AK100 World Tour (hereon referred to as "the Project").

Article 1  Membership Terms of Use
The members, as defined in Article 3, are required to abide by the Terms of Use during and after membership registration in order to have access to the services provided by "www.ak100wt.com" and "affiliated sites" (hereon referred to as "the Service").

Article 2  Changes in Terms of Use
(1) The Project reserves the right, at its sole discretion, to change portions of these Terms of Use by notifying members via communication mode deemed appropriate by the Project. Any change will be effective upon posting by the Project on the www.ak100wt.com website.
(2) Conditions of usage for member services subsequent to changes in the Terms of Use will be based on the revised Membership Terms of Use.

Article 3  Members
Members refer to individuals who have accepted the Terms of Use and completed membership registration on the website and whose registration has been approved by the Project.

Article 4  Registration
When registering for membership, the member him/herself should carefully read the directions for filling out the form and accurately type in the required fields. The Project reserves the right to reject registration when the registered information is incomplete or false, or when the individual is deemed harmful to "www.ak100wt.com" and/or "affiliated sites".

Article 5  Notification of Changes
Members agree to promptly update changes in the information registered through the designated process.

Article 6  Account Ownership
Members may not transfer, lend, sell, change the name of ownership, or register their rights of membership to any form of a pledge.

Article 7  Termination of Membership
The Project reserves the right to terminate membership without prior notice if the following applies. The Project will not be responsible for any loss and damage that might occur to the member or a third party following the termination.
(1) When the member violates any of the rules listed in Article 8
(2) When information submitted for membership registration and notifications were false
(3) When the Project cannot reach the member through telephone, FAX, e-mail and other forms of communication
(4) When the member failed to adhere to these Terms of Use
(5) When the member is deemed inappropriate by the Project
(6) When the member requested withdrawal

Article 8  Member Conduct
Members agree not to do the following using the Service:
(1) Defame others through slander and abuse
(2) Violate the law or public order
(3) Use the Service for commercial or soliciting purposes
(4) Damage or harass others
(5) Use the Service in a manner that could impair the Service
(6) Provide information obtained by the Service to a third party other than for personal use without prior approval from the Project.
(7) Transfer images, pictures, sounds and other digital data presented in the Service to third parties

Article 9  Offering of Services
The Service reserves the right to change, add, or remove some or all of its services for any reason without prior notice to its members.

Article 10  Disclaimer
Members will use the Services at their own risk. In no event will the Project be liable for the Service's completeness, accuracy, applicability, and/or utility.

(1) The Project and Regional Companies assume no responsibility for loss or damage caused by delay, interruption or cancellation of services due to communications line and computer failures, or for loss or damage to members due to falsification by a third party.
(2) The Project and Regional Companies does not guarantee that no harmful contents such as viruses are contained in e-mails sent from its web-pages and server.
(3) The Project and Regional Companies will not be involved in any individual conflicts that may arise from the sending and receiving of e-mails and messages between any member and user.
(4) The Project and Regional Companies are not responsible for any loss or damage due to violation of these Terms and Conditions by its member.

Article 11  Use of Personal Information
The Project will properly use its members' personal information (hereon referred to as "Personal Information") based on the Privacy Policy posted on the "www.ak100wt.com" site. It will not use the registered information other than to manage, conduct services and identify members in "www.ak100wt.com" and "affiliated sites", with the following exceptions.
(1) When the Project sends notification e-mails and other forms of information, or displays information on "www.ak100wt.com" and "affiliated sites".
(2) When the Project uses personal information to respond to inquiries from members or provide individual services such as follow-ups.
(3) When the Project discloses demographic data to a third party by gathering, analyzing and preparing them in such a way where individuals cannot be identified.
(4) When the Project deems disclosure is necessary to protect life, health, asset, and/or other important conditions of the public.
(5) When the court, police, prosecutor's office, government body, bar association, etc. requests disclosure based on legal authority.
(6) When the Project rationally deems that cooperating with police or criminal investigation is necessary.
(7) When the Project rationally deems that disclosure is necessary to maintain its Services.

Article 12  Governing Law
The laws of Japan will govern these Terms of Use for its establishment, validity, and interpretations.

Article 13  Resolution of Conflict
Members and the Project agree that if conflict occurs between them in relation to the Project's membership services, both parties will hold a discussion with sincerity and come to an agreement. In cases the conflicts do not settle, the Project will designate a district court as the exclusive jurisdictional court.

Additional Clause: These Terms and Conditions will be effective September 18, 2008.
